Comcast is being accused of cutting down the competitor’s fiber

Telecom Cable LLC owned “229 satisfied customers” in Weston Lakes and Corrigan, Texas while Comcast and its contractors damaged its network, the lawsuit registered last week in Harris County District Court said.

Comcast had proposed to buy Telecom Cable’s Weston Lakes services in 2013 “but declined to pay what they were worth,” the charge says. Starting in June 2015, Comcast and couple of contractors it hired “systematically destroyed Telecom’s business by cutting its wires and running off its customers,” the lawsuit says. Comcast killed or damaged the lines working all Telecom Cable customers in Weston Lakes and never repaired them, the lawsuit claims.

Telecom Cable partner Anthony Luna determined the value of his business at about $1.8 million, which he is endeavoring to recover. He is also asking other damages from Comcast and its contractors, including typical damages that under state law could “amount to a peak of twice the amount of economic losses, plus up to $750,000 of non-economic damages,” the complaint says.

CourtHouse News Service has a story regarding the lawsuit, and it mailed a copy of the complaint.

“We object to Telecom’s claim and will firmly defend ourselves,” Comcast VP Ray Purser said in a report provided to News. Comcast did not give any further response to the allegations and has not yet registered an official answer to Luna’s complaint.

Luna says he did not oppose Comcast’s approach into Weston Lakes. Before Comcast began construction, Telecom Cable “made extraordinary efforts to mark its lines and equipment to prevent any accidental damage. Using an RF accentuated transmitter and inductive attachment to the cable, Mr. Luna located Telecom’s underground lines and marked the wires with industry-standard orange paint, as well as ‘buried cable flags’ for quick and easy identification,” the complaint says. “Mr. Luna also posted a map of Telecom’s system to the Director of Construction at Comcast’s Tidwell office.”

But then Luna was informed of service outages and “rushed to the job site” where he “found his severed mainline wire” along with Comcast contractors who were establishing their own cable, the complaint says.
