FCC is facing Lawsuit again for not submitting comments to the Net Neutrality Prosecutors

Freelance writer Jason Prechtel registered a Freedom of Information Act -FoIA request on June 4 urging the FCC for data compared to bulk comment uploads, which may include comments falsely connected to people out their knowledge. But while the FCC confirmed receiving his FOIA request, it did not confirm or deny the demand within the authorized allotted timeframe, Prechtel wrote in a lawsuit registered in the US District Court for the District of Columbia.

“As the bureau is legally obliged to answer to my request, and as the underlying subjects behind my question still haven’t been said, I have filed a suit against the FCC for its unwillingness to accompany a reasonably timely research for the records, and have demanded the release of these records,” Prechtel addressed in a blog post detailing his court charge on Friday. “Even now, over three months after my FOIA appeal, and even after I’ve filed a suit, this request is still labeled as ‘under agency review.'”

Prechtel’s court accusation includes a copy of messages between himself and the FCC. The council notified him on June 14 that it would be stretching the deadline for replying to his request from July 3 to July 18.

After the July 18 deadline passed, Prechtel addressed to the FCC to ask when he should expect an answer to his FOIA request.

“I never listened from the FCC again,” Prechtel wrote.

There are higher than 22 million public comments on Pai’s plan to cancel the commission’s net neutrality rules, which stop ISPs from interfering with Internet traffic and add various other consumer protections.

Prechtel wrote that “Public comments under real people’s names were determined to have been posted externally their knowledge” and that “Multiple analyses required that up to millions of comments pro- or anti was likely faked.”

Figuring that it is individually easy to fake remarks using the FCC’s system for uploading observations in bulk, Prechtel sought data on those bulk uploads.

“Fortunately, these bulk comments couldn’t be sent entirely anonymously,” he wrote. “The Bulk Upload Template design also required the submission of the uploader’s e-mail address. The API method needed a valid e-mail address to get the necessary Data.gov API key to start with plus, the whole point of an API key system is to give and track individual user way to a given server.”
